By using or accessing this site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, then please do not use this site.

Governing law

Officeworks controls and operates this web site from its offices within Australia. Our Terms of Use are governed by the laws of the State of Victoria. You and Officeworks agree to submit to the non-exclusive jurisdiction of the courts of Victoria. If you choose to access this site from another location, you are responsible for compliance with applicable local laws.

Officeworks may revise or amend these Terms of Use at any time at our absolute discretion by posting revised terms. You agree that, in the event that any portion of these Terms of Use is found to be unenforceable, the remainder of these Terms of Use remain in full force and effect. Products may vary between Officeworks retail stores and Officeworks BusinessDirect.

Ordering goods

Any order placed by you in the manner described in this site is an offer by you to purchase a particular product or service for the price (including the delivery and other charges) specified on this site at the time you place your order. You acknowledge that, by placing your order, you are agreeing to pay for and accept delivery of the goods ordered unless you ask us to cancel that order, and we send you written confirmation of the cancellation prior to the goods being dispatched to you. Officeworks may change the prices published on this website at any time. Prices of products placed in the 'basket' but not paid for are also subject to change and you agree to pay the price current at the time of payment. While every effort has been made to ensure the accuracy of prices and information displayed on the Officeworks website, Officeworks reserves the right to accept or reject your offer for any reason, including without limitation, the unavailability of any product, an error in the price or the product description posted on this site, or an error in your order. We may require additional verification or information before accepting any order. We only accept orders from within mainland Australia and Tasmania. Within this area, our policies as to delivery and returns apply as set out in these Terms of Use.

About our prices

Product availability may vary between Officeworks retail stores and Officeworks BusinessDirect due to their different customer offers. All prices are inclusive of GST. Prices displayed on this site are current at the time of issue, but may change at any time and are subject to availability. Prices and availability of items are subject to change without notice. Where permitted in all states (excluding SA), we reserve the right to limit sales, including the right to prohibit sales to re-sellers. We are not responsible for typographical or photographic errors on this site, including any such errors in relation to prices.

Officeworks BusinessDirect payments

Payments to Officeworks BusinessDirect can be made by any credit card or an Officeworks BusinessDirect 30 Day Account. We offer a free 30-day account for eligible customers. With a 30-day account we will ship your order the same day that you call us, then send the invoice to you. You can take up to 30 days to pay. To find out if you qualify for an account, speak to one of our helpful representatives. The price payable for goods ordered is the price specified on this site, plus any applicable shipping and handling charges. Prices are inclusive of GST.

Title to the goods purchased on this site does not pass from Officeworks BusinessDirect to you until we have received payment in full for the goods. All risk in the goods passes to you upon delivery to your address.

Officeworks Photobooks Terms and Conditions

The Officeworks Photobooks website is owned and operated by Officeworks Superstores Pty Ltd ABN 47 083 921 215, (Officeworks) a subsidiary of Coles Group Limited, in conjunction with Album printer Pty Ltd (Album printer). By using or accessing this site you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, then please do not use this site.

1. Governing Law

Officeworks and Album printer control and operate this web site from its offices within Australia. Our Terms of Use are governed by the laws of the State of Victoria. You and Officeworks and Album printer agree to submit to the non-exclusive jurisdiction of the courts of Victoria. If you choose to access this site from another location, you are responsible for compliance with applicable local laws.

2. Order acceptance

a) All orders are accepted and handled in accordance with the conditions below.
b) The customer accepts these conditions by using the Officeworks Photobook Album Editor software.
c) After completing the order, we will store the file provided by you on the server for one month. This is to enable you to order further copies of the album at a later stage. After one month it will be deleted however you may re-upload your album after this period to re-order. 
d) For each online order, you must pay:
  • the applicable price for the relevant goods confirmed by Officeworks Photobooks; and
  • the delivery and handling fee specified on the website at that time.

Your order and credit card details are safe and secure. All personal and credit card information provided to Album printer is encoded using Secure Sockets Layer (SSL) technology, an encryption protocol that protects data as it travels over the Internet.
e) Flybuys, Coles Group staff discount, and the Officeworks 30 Day Account Card are not currently available on Officeworks Photobooks website.

3. Site Contents, Ownership & Use Restrictions

4. Copyright

a) You are solely responsible for the contents of file you submit and in obeying the laws of Australia.
b) Officeworks Superstores Pty Ltd and Album printer Pty Ltd do not accept responsibility for the contents of the file you submit.
c) You warrant that you are either the owner of the copyright OR you have a license to reproduce the photographs and files uploaded into Officeworks Photobooks.
d) You agree to indemnify and will keep Officeworks and Album printer indemnified against any claim, demand, injury, damage, loss, expense, cost or liability (whether direct or indirect) made against or suffered by Officeworks and/or Album printer in connection with your use of this site, your breach of these Terms of Use or your breach of any rights of third parties.
You must not upload, post, transmit or otherwise make available through the site any material which:

5. Liability

a) Officeworks and Album printer Pty Ltd shall not accept liability for damage or loss of the files.
b) Officeworks emphasises that the quality of the prints in the albums ordered will never be better than is to be expected on the basis of what you see on your computer monitor when using the Album Editor. Take care in proofing and previewing your photo product and carefully check your spelling before ordering.
c) Officeworks and Albumprinter's total liability is limited to errors which are related to production, shipping and delivery of the product.
(d) Protecting Your Log on Details
You agree to take responsibility for the safekeeping of your user name and password. You are liable if your user name or password is used by an unauthorised person. You agree to release and indemnify Officeworks and Album printer in connection with any use (whether authorised or unauthorised of your user name or password).

6. Delivery time

a) The delivery will be completed within 10 business days to your nominated addresses or nominated Officeworks store.
b) If delivery cannot be made to your home, a card will be left by Australia Post explaining how you can receive delivery or pick-up the product at your post office.
c) Delayed delivery is not a basis for cancellation of the order or a request for compensation.

7. Guarantee

a) Any complaints must be submitted within one week of the delivery of the materials ordered by you to productsupport@photobooks.officeworks.com.au
b) Officeworks and Albumprinter’s liability is limited to resupplying the ordered materials again.

8. Disclaimer of Warranty

Officeworks and Album printer is providing this site and its contents on an 'as is' basis and use of this site is at your own risk. The content is believed to be accurate, complete, current and reliable at the date the information was placed on the site.
Officeworks and Album printer and its related companies, affiliates, licensors or licensees, and their respective directors, officers, employees or agents make no representation or warranty as to the accuracy, completeness, currency or reliability of the information contained on this site (including in relation to any products or services).
To the extent permitted by law, including any non-excusable statutory obligations, none of them will be liable or responsible in any way (including in negligence) for errors in, or omissions from, the information contained - on this site.   • In the case of goods supplied or offered by us – repair or replacement of the goods, supply of equivalent goods, or payment of the cost of doing this.
  • The amount paid by you (if any).

The above disclaimer and liability limitation do not exclude any rights, which by law may not be excluded, including but not limited to your rights under the Trade Practices Act.
